Approval, Licensing and Registration of a Factory

Approval
As per Section 6 of the Factories Act, 1948, prior permission of the Chief Inspector of Factories is to be obtained for the site on which the factory is to be situated and for the construction or extension of any factory or class or description of factory
Application is to be made in Form I-C, with the following documents.

  1. Paid Challan receipt towards scrutiny fee Scrutiny Fee: Small Scale Industries - Rs. 100/- Medium Scale Industries - Rs. 500/- Large Scale Industries - Rs.1000/-
  2. Plans in Triplicate indicating all relevant site plan, cross section, elevation etc
  3. Copy of the Certificate of registration from Industries Department
  4. Copy of the Land / Building document
  5. Detailed flow chart of the manufacturing process in various stages signed by the occupier
  6. Detailed description of the process indicating the various stages signed by the occupier
  7. In the case of existing building, details, of the previous occupier and cancellation of the factory license / registration of the previous factory
  8. Copy of the partnership deed, memorandum / articles of association
  9. Clearance / NOC from Puducherry Pollution Control Committee (for Hazardous Industries)

Licensing
As per section 6 of the Factories Act, 1948 read with Rule 4 of the Puducherry Factories Rules, 1964, no premises shall be used as a factory nor any manufacturing process carried on in any aspect except under and in accordance with the registration and license granted under these rules

The Application shall be in Form-2 along with the Certificate of stability obtained from a competent person and accompanied by Challan receipt-evidencing payment of the appropriate fee specified in the Schedule

Licensing Fees

If the Chief Inspector is satisfied that the registration and licence may be granted, such registration and license will be issued

Renewal
The application for renewal of license shall be made to the Chief Inspector of Factories in Form-2 The application shall be made not less than 2 months before the date on which the license expires and shall be accompanied by the original license with fee paid. The same fee shall be charged for the renewal of a licence as far the grant thereof
The late fee for belated submission is as follows:-

  1. Ten percent of the fee payable, the application for renewal is received not less than one month before the date of expiry of the license
  2. Twenty percent of the fee payable, if the application for renewal is received within a month before the expiry of the license
  3. Thirty percent of the fee payable, if the application for renewal is received after the expiry of the license

Amendments
The limits specified in the license with regard to the HorsePower or the no. of persons employed shall not be altered or the name of the factory changed unless the license has been amended by the Chief Inspector of Factories

An application for such amendments shall be made to the Chief Inspector of Factories at-least 15 days prior to the date on which the applicant desires the amendments to take effect. The fee shall be Rs.5/- for each amendments

Loss of Licence
The fee for grant of duplicate LICENCE is Rs. 50/-

Notice of Change of Manager
The notice of Change of Manager shall be in Form 3A
